When Do You Need One?
You'll need an LMIA if you're hiring a caregiver who is not already in Canada with valid work authorization. This is common for families seeking live-in caregivers, as the pool of available caregivers already in Canada can be limited.
If your preferred caregiver is already in Canada with an open or transferable work permit, the process may be simpler. We'll assess your situation and advise on the best path.
The Process Step by Step
- Recruitment Effort — You must demonstrate that you've actively tried to hire a Canadian caregiver (posting on job boards, etc.) for at least 30 days. We guide you through this requirement.
- Application Submission — We prepare and submit the LMIA application to ESDC, including all required documentation about the job, the caregiver, and your household.
- Government Review — ESDC reviews the application. Processing times vary, but typically take several weeks to a few months.
- Positive LMIA — If approved, you receive a positive LMIA, which your caregiver uses to apply for a work permit.
- Work Permit Application — Your caregiver applies for their work permit through Immigration, Refugees and Citizenship Canada (IRCC).
